A Will ensures that your wishes are followed when you die, but a Lasting Power of Attorney (LPA) ensures they are followed when you are alive.
If you do not make a LPA and you lose your mental capacity the Court of Protection will act on your behalf. This is a costly, stressful and time consuming process for your family. By creating an LPA now, you are in control of making decisions and it is less complicated for your family, in the long run.
There are 2 types of Lasting Power of Attorney. You can choose to make both types or just one.
This allows the person acting on your behalf to make decisions regarding money matters, such as selling your home, paying your bills collecting benefits or a pension and managing your bank or building society account.
This is needed on some specific cases for decisions regarding where you live, your daily routine and how you should be treated medically.
We charge £395 + vat for a single Lasting Power of Attorney or £700 + vat for a pair. All LPAs must be registered with the Office of the Public Guardian for which they charge a further fee of £82 payable to register each LPA.
You may be exempt from paying the registration fee if you’re on a low income or if you receive certain income related benefits.
